Welcome to BidList. By accessing or using our website at bidlist.io and related subdomains (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.

1. About Our Service

BidList is a marketplace platform that connects homeowners with licensed roofing contractors. We help you request and compare quotes for roofing projects. We are not a roofing contractor, general contractor, or construction company. We do not perform, supervise, or guarantee any roofing work.

2. No Guarantee of Contractor Work

BidList does not employ, endorse, or guarantee any contractor in our network. While we make reasonable efforts to work with licensed professionals, we make no warranties or representations regarding the quality, safety, legality, or timeliness of any contractor's work. Any agreement you enter into with a contractor is solely between you and that contractor.

You are responsible for verifying a contractor's licenses, insurance, and references before entering into any agreement.

3. Limitation of Liability

To the fullest extent permitted by law, BidList and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any services arranged through the Site, including but not limited to:

• Property damage or personal injury resulting from contractor work.
• Disputes between you and a contractor.
• Inaccurate quotes, estimates, or project timelines.
• Loss of data or unauthorized access to your information.

In no event shall our total liability to you exceed the amount you paid us (if any) in the twelve (12) months prior to the claim, or one hundred dollars ($100), whichever is greater.

4. Disclaimer of Warranties

The Site and all content, materials, and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5. User Responsibilities

By using the Site, you agree to:

• Provide accurate and complete information in any forms you submit.
• Not use the Site for any unlawful purpose or in violation of these Terms.
• Not submit false, misleading, or spam requests.
• Not attempt to interfere with the Site's operation or security.

By submitting photos, documents, notes, or other content through the Site, you grant BidList a non-exclusive, royalty-free license to use, store, and share that content as necessary to provide our services (e.g., forwarding project photos to contractors). You represent that you have the right to submit any content you provide.

8. Third-Party Links & Services

The Site may contain links to or embed content from third-party websites and services. We are not responsible for the content, privacy practices, or availability of those third parties. Your use of third-party services is at your own risk and subject to their terms.

9. Indemnification

You agree to indemnify and hold harmless BidList and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state where BidList maintains its principal place of business. You agree to waive any right to a jury trial or to participate in a class action.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which BidList operates, without regard to conflict of law principles.

12. Termination

We reserve the right to suspend or terminate your access to the Site at any time, for any reason, without notice. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall survive.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
